Crest’s Barrister, David Hart QC discusses the first large remediation notice for contaminated land that was served in the UK and was aired in the courts – Crest Nicholson Residential Ltd v Secretary of State for Environment, Food and Rural Affairs, EA, Redlands Minerals Thames Water Utilities Ltd, Veolia Water Central Ltd [2010] EWHC 561 (Admin). We focus on the facts and stages of the case, the role of the environmental consultants, how important environmental reports were throughout negotiation of the notice and during litigation as evidence in court.
