Environmental Permitting (England and Wales) Regulations 2016

After 15 amendments since 2010, the Environmental Permitting (England and Wales) Regulations 2010/675 are repealed and we now welcome the Environmental Permitting (England and Wales) Regulations 2016 SI 2016/1154, in force 1 January 2017.

This is not a statutory review but merely a tidying up exercise of the 2010 Regulations which had become too difficult to handle.  A statutory review is proposed for 2019.

The Government provided with the consultation a sometimes useful, other times confusing correlation table:  watch out for the Schedule section as it does not follow the order set out in the actual Regulations. For example, you will still find ELV at Schedule 11 and WEE at Schedule 12.
